Terms of Service

Acceptance

By creating an account or using the Eventually platform, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service. These terms apply to all users, including event organizers and attendees. Stoic Marketing Consulting, trading as Eventually, reserves the right to update these terms at any time; continued use after changes constitutes acceptance.

The service

Eventually is a cloud-based event management platform that allows users to create, manage, and attend events. We provide tools for ticketing, RSVP management, attendee communication, and event analytics. The platform is provided on an "as is" basis and is subject to change. We may modify, suspend, or discontinue any part of the service with reasonable notice where possible.

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to create an account. You agree to notify us immediately at hello@eventually.one if you suspect unauthorised access to your account. We are not liable for losses resulting from unauthorised use of your account.

Payments

Subscription fees are processed securely by Stripe. By providing payment details, you authorise us to charge the applicable fees. All fees are listed in euros (EUR) and are exclusive of VAT where applicable. Payments are generally non-refundable. Exceptions apply if an event is cancelled by the organizer, in which case attendees are entitled to a full refund of any ticket fees collected through the platform. Disputes regarding charges should be directed to hello@eventually.one.

Billing trigger

For Pay Per Event subscriptions, the €9.99 per-event fee is charged at the moment you click "Publish" — when an event is made live and publicly accessible. Creating, editing, or previewing draft events does not incur any charge. Draft events are available at no cost on all plans. For Pro subscribers, there is no per-event charge — the monthly or annual subscription covers unlimited event publications.

First event free

Every new organisation receives access to publish one event at no cost — no credit card required. You may create unlimited draft events for free. This offer applies to your first published event: you receive full platform access with no charge. After your first published event, your account remains active — you can log in, view past data, manage contacts, and access event reports. To publish a second event, you must choose a paid plan (Pay Per Event at €9.99/event or Pro at €29/month).

We reserve the right to modify the first-event-free offer at any time. If we make material changes, we will notify registered users by email at least 30 days before the change takes effect.

Refund policy for per-event charges

The following refund rules apply to the €9.99 per-event fee:

  • Unpublish before any registrations: Full automatic refund. If you unpublish your event before any attendees have registered, the €9.99 charge is refunded in full automatically.
  • Unpublish after registrations: No refund. Once attendees have registered, the platform has delivered value (hosted your event page, sent confirmation emails, collected registrations). The charge is non-refundable.
  • After any check-in: No refund. Once any attendee has checked in, the event is considered complete and the charge is non-refundable.
  • Cancellation on the same day, before any registrations or check-ins: Full automatic refund, provided no attendees have registered or checked in.

Pro subscription fees (monthly or annual) are governed by the standard cancellation policy. See the "Termination" section below. Pro subscription fees are not refunded on a pro-rata basis upon cancellation — access continues until the end of the billing period.

Pricing and plan changes

We reserve the right to modify our pricing, plans, or fee structure at any time. If we change pricing in a way that materially affects your subscription, we will notify you by email at least 30 days before the change takes effect. You may cancel your subscription before the new pricing applies. Continued use after the effective date constitutes acceptance of the updated pricing. We will not increase pricing retroactively for billing periods already paid.

Third-party payment processing fees (such as Stripe's transaction fees) are set by those providers and may change independently of our pricing. We will make reasonable efforts to communicate material third-party fee changes that may affect your costs, but we are not responsible for fee changes imposed by payment processors, infrastructure providers, or other third-party services.

Third-party services

The Eventually platform relies on third-party service providers to deliver core functionality:

  • Stripe — payment processing. Subject to Stripe's own terms, fees, and service availability.
  • Vercel — hosting and content delivery. Subject to Vercel's terms and uptime.
  • Supabase — database and authentication. Hosted in the EU (Frankfurt).

We are not responsible for outages, fee changes, policy changes, or service disruptions caused by third-party providers. If a third-party change materially affects the service we provide, we will communicate the impact and any alternatives available to you. We select providers with strong reliability track records but cannot guarantee their continuous availability.

Organizer responsibilities

If you use Eventually as an event organizer, you are solely responsible for:

  • The legality, safety, and content of your events.
  • Compliance with applicable laws, including consumer protection, tax obligations, and venue regulations in your jurisdiction.
  • The accuracy of event information (dates, venue, pricing, descriptions) you publish through the platform.
  • Handling attendee disputes, complaints, and refund requests for your events.
  • Collecting and remitting any applicable taxes (VAT, sales tax) on ticket sales.
  • Obtaining all necessary permits, licences, or insurance for your events.

Eventually provides the ticketing technology; the event itself is your responsibility. We are not a co-organizer, promoter, or insurer of your events.

Service availability

We target 99.9% uptime for the Eventually platform but do not guarantee uninterrupted service. The platform is provided on an "as is" and "as available" basis. We may perform scheduled maintenance during low-traffic windows and will provide advance notice where reasonably possible.

We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or free of harmful components.

Prohibited uses

You may not use Eventually to:

  • Organise or promote illegal events or activities under Dutch or EU law.
  • Engage in fraud, misrepresentation, or deceptive practices, including selling tickets to non-existent events.
  • Engage in ticket scalping, price gouging, or operating a secondary ticket market outside our built-in resale feature.
  • Create fake accounts, fake events, or artificially inflate ticket sales or attendance figures.
  • Initiate chargebacks or payment disputes in bad faith to obtain services without payment.
  • Harass, threaten, or harm other users.
  • Distribute spam, malware, or unsolicited communications via the platform's messaging features.
  • Scrape, reverse-engineer, or attempt to extract source code from the platform.
  • Circumvent rate limits, security measures, or access controls.
  • Use the platform in a way that violates any applicable law or regulation.
  • Resell, sublicence, or share your Eventually account access with unauthorised third parties.

Violations may result in immediate account termination without refund.

Fair use and abuse prevention

To protect the platform and its users, we enforce fair use policies:

  • API access is subject to rate limits. Excessive automated requests may be throttled or blocked.
  • Accounts used for fraudulent ticket sales, fake events, or ticket scalping will be suspended immediately.
  • Chargebacks and payment disputes initiated in bad faith may result in account suspension and recovery of costs.
  • We reserve the right to suspend or terminate any account that, in our reasonable judgment, poses a risk to the platform, its users, or our reputation.

If your account is suspended, you will be notified by email with the reason. You may appeal by contacting hello@eventually.one.

Indemnification

You agree to indemnify, defend, and hold harmless Stoic Marketing Consulting (trading as Eventually), its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the platform; (b) events you organise through the platform; (c) your violation of these terms; (d) your violation of any applicable law or the rights of any third party; or (e) any content you publish through the platform.

Force majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, cyberattacks, third-party service outages (including but not limited to Stripe, Vercel, or Supabase), internet connectivity disruptions, power failures, or labour disputes. During such events, our obligations are suspended for the duration of the force majeure event, and we will make reasonable efforts to resume service as soon as practicable.

AI-powered features

Eventually uses AI services from Google (Gemini), OpenAI, and Anthropic to power certain platform features. By using these features, you acknowledge that content you submit may be processed by these third-party AI providers in accordance with their terms and our Privacy Policy. You are responsible for ensuring that any content you submit to AI-powered features does not violate applicable law or the rights of third parties. AI-generated outputs are provided for informational purposes and may not always be accurate — you should review them before use.

Intellectual property

The Eventually platform, including its design, code, trademarks, and branding, is owned by Stoic Marketing Consulting and protected by intellectual property law. You retain full ownership of the event content you create (descriptions, images, attendee data). By using the platform, you grant us a limited, non-exclusive licence to host and display your content solely for the purpose of providing the service.

Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or business opportunities. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these terms limits liability for fraud, gross negligence, or death or personal injury caused by our negligence.

Termination

Either party may terminate the agreement at any time. For paid plans, we request 30 days written notice before the next billing cycle to avoid additional charges. You may delete your account at any time via account settings. We may terminate or suspend accounts that violate these terms without prior notice. Upon termination, your right to use the platform ceases and your data will be handled per our Privacy Policy.

Right of withdrawal

Under EU consumer law, you have a 14-day cooling-off period from the date of subscription. To exercise this right, contact us at hello@eventually.one before the 14-day period ends. If you have already used the service during this period, we may deduct a proportional amount.

Governing law

These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, Netherlands, unless mandatory consumer protection law in your country of residence provides otherwise.
